Upon full payment, clients receive ownership rights to deliverables as specified in the project agreement. CometByte retains the right to showcase completed work in our portfolio unless otherwise agreed.

5. Payment Terms

• Invoices are due within the timeframe specified in the agreement
• Late payments may incur additional fees
• Services may be suspended for non-payment
• All prices are exclusive of applicable taxes unless stated otherwise

6. Project Timelines and Deliverables

We strive to meet all agreed-upon deadlines. However, timelines may be affected by factors such as client feedback delays, scope changes, or unforeseen technical issues. We will communicate promptly about any timeline adjustments.

7. Warranties and Disclaimers

7.1 Service Warranty

We warrant that our services will be performed with reasonable care and skill. We will make reasonable efforts to correct any defects in our services at no additional charge within the warranty period specified in the project agreement.

7.2 Disclaimer

Our services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee uninterrupted or error-free service. We are not responsible for third-party services or products.

8. Limitation of Liability

To the maximum extent permitted by law, CometByte shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by the client for the specific service giving rise to the claim.

9. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information shared during the course of the project. This obligation survives the termination of the agreement.

10. Termination

Either party may terminate the service agreement:

• By providing written notice as specified in the project agreement
• Immediately for material breach by the other party
• For convenience with appropriate notice and settlement of fees

Upon termination, the client remains responsible for payment of services rendered up to the termination date.

11. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond their reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions.

12. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes may be submitted to mediation before pursuing legal action.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Republic of India, depending on the jurisdiction of service delivery.

14. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
